Uganda: Supreme Court verses Military court.

Following the January 31 landmark decision of the Supreme Court, Law framers says that  Ignoring the decision

would set a dangerous precedent where judicial authority is disregarded at will, effectively undermining the entire legal framework of Uganda. 

If the Executive or military can override Supreme Court decisions, the rule of law itself becomes a facade. 

This would create a ripple effect where citizens lose confidence in the judiciary, leading to legal anarchy.

“The Continued military trials for civilians would invite international condemnation, affecting Uganda’s global standing and possibly leading to sanctions that could impact its economy and governance” they said.

One of the most immediate impacts of this ruling is on individuals like opposition politician figure Dr. Kizza Besigye and others who has faced military charges for years. 

This epitomizes how military courts have been used as political weapons rather than as instruments of justice.

The Chief of Defence Forces (CDF), in response to the ruling, echoed sentiments similar to those of the President, suggesting that military courts remain essential for maintaining national security. 

These comments reflect an institutional reluctance to cede power and acknowledge civilian judicial supremacy.
