Court Delays Case on Mubaje’s Re-election

The High Court in Kampala has ruled that a case challenging Sheikh Shaban Ramathan Mubaje’s re-election as Mufti of Uganda cannot proceed until all 45 respondents, including Mubaje and members of the electoral college, are properly served. Judge Emmanuel Baguma set a deadline for service by April 16, 2025, with the next hearing scheduled for April 28, 2025.

The case was filed by Sunni Muslims led by Swaibu Nsimbe, Twayibu Byansi, Musa Kalokora, and Musa Kasakya, who argue that Mubaje is ineligible for another term due to exceeding the 70-year retirement age outlined in the old Uganda Muslim Supreme Council (UMSC) Constitution. They also accuse him of mismanaging property and lacking transparency.

The UMSC, represented by Musa Kabega, contends that the matter should be resolved internally and that the petitioners lack standing to challenge the election. The council also argues that the religious body that endorsed Mubaje’s election is beyond judicial review.

Mubaje, who turned 70 on March 12, 2025, was sworn in for another term despite the age limit. The petitioners seek a court declaration that his re-election is unconstitutional.

In defense, supporters of Mubaje argue that the 2022 UMSC Constitution allows for a retirement age extension to 75, and highlight his contributions to the Muslim community’s stability.
