Effectively Legalizing Abortion Nationwide

January 22 marks a significant milestone in American history – the issuance of the landmark Supreme Court decision in Roe v. Wade. On this day in 1973, the court ruled 7-2 that unduly restrictive state regulation of abortion is unconstitutional, effectively legalizing abortion nationwide.

The case centered around “Jane Roe,” a pseudonym for Norma McCorvey, a single, pregnant woman who challenged the constitutionality of Texas’s abortion laws. The court held that a woman’s right to privacy, as protected by the 14th Amendment, includes her decision to have an abortion.

The decision was a pivotal moment in the women’s rights movement, affirming a woman’s right to choose and make decisions about her own body. However, it has also been a source of ongoing controversy and debate, with many states imposing restrictions on abortion rights over the years.

In 2022, the Supreme Court overturned Roe v. Wade in the case of Dobbs v. Jackson Women’s Health Organization, effectively ending the constitutional right to abortion.
